At the beginning of May, the Supreme Court rejected a complaint against the king emeritus for crimes against the Public Treasury based on the report of the Public Prosecutor's Office which opposed the admission of the complaint considering that the facts do not constitute a crime, in other cases they are time-barred or have been regularised. The court considers that in legal terms, nothing has changed since the Prosecutor's Decree of dismissal 3 years ago for the same facts.
According to the statement: "The Supreme Court accepts the criteria of the Public Prosecutor's Office, contrary to the admission of the complaint, and points out that the facts investigated were already the object of a reasoned archive by the Anti-Corruption Prosecutor's Office, and that the complaint presented does not provide new data, evidence or documents that justify reopening the investigation".
"In his order, he considers that "the fragmented and self-interested selection" of the prosecutor's decree to close the case "cannot now be the determining cause for the opening of criminal proceedings against the aforado. In legal terms, nothing has changed three years later to raise the reasoned and congruent decision of the Public Prosecutor's Office and agree to the opening of criminal proceedings".

The complaint, filed by a group of jurists, philosophers and journalists, in the exercise of popular action, claimed that the King Emeritus had committed five tax crimes related to undeclared income and donations through foundations such as Zagatka and Lucum.
The plaintiffs argue that the tax regularisations carried out do not meet the legal requirements for exonerating criminal liability and that the offences are not time-barred by the statute of limitations, as they are aggravated by the use of opaque structures abroad.
Now, the popular accusation has appealed the Supreme Court's decision not to investigate these five alleged tax crimes of the honorary king and they ask the Second Chamber to reconsider and protect the principle of equality before the law. Here you can read the appeal.
