Social Security and 529 delivery drivers win the first macro lawsuit against Deliveroo in Spain.

The sentence the decision against Deliveroo, which can still be appealed before the High Court of Justice of Madrid, establishes that there is an employment relationship. Its delivery drivers are salaried and not self-employed, so the company will have to pay Social Security for them.

"I declare, with the corresponding legal effects, that the co-defendant workers were subject to an employment relationship with Roofoods Spain during the time in which they respectively rendered their services in the period covered by the liquidation act, condemning the aforementioned company to stand and pass for it".

This is not the first judgement against Deliveroo in this sense, in June 2018 a court in Valencia ruled for the first time that one of its workers was false self-employed, that he had established an employment relationship with the company and that his dismissal had been unfair and not null and void.
